Triple Talaq is a process of divorce under Sharia Law where a husband can divorce verbally by uttering the word 'talaq' three times. There are three types of disunion in Islamic Law- Ashan, Hasan and Talaq-e-biddat. It is usually prevalent in Indian Muslim communities who follow Hanafi School of Islamic Law. It gives Muslim men arbitrary right to annul the marriage while the women have to approach the court as it is not applicable to them.
Muslim women on several occasions have pitched their voice against this practice as it questions their dignity as a human and the advent of new technologies has given rise to new modes of talaq through Chatting apps, email, letter. There is much debate over its validity and necessity in a secular country like India. Notably, when Muslim countries like Bangladesh, Pakistan has done away with it. While rights activists suggest the repeal of such practice, Muslim Personal Law Board advocates it as an integral part of their religion granted under Article 25. Although on many occasions Supreme Court has upheld that any personal law can't be above the Constitution. While Article 14 insists on 'Right to Equality' and Article 15(1) forbids discrimination based on gender, such practice requires a thorough review.
As more and more Muslim women are coming forward demanding justice and the judiciary voiced the concern through its judgement, it is high time Shariat Law introspected. All civil bodies should unite to give women the right to live with decency.
